Practice and enlightenment in the comprehensive protection of intellectual property rights for proprietary Chinese medicines:a case study of the Tasly nourishing serum brain series products

Abstract
Objective:To explore the development of Chinese medicine big health industry and how to protect the core technology of Chinese medicine and maintain the competitive advantage in the market by means of patent portfolio strategy,patent litigation and Chinese medicine variety protection.Methods:By analyzing the patent portfolio strategy,patent litigation cases and the use of the Chinese medicine variety protection system of Tianshili in the Chinese medicine big health industry,we summarized its methods of protecting core technology.Results:It provided valuable experience for the construction of the intellectual property protection system of Chinese medicine,provided reference for exploring the method of constructing a replicable and popularized comprehensive intellectual property protection system of Chi-nese medicine characteristics,and also provided reference for other Chinese medicine enterprises in terms of intellectual property protection of core technologies and products.Conclusion:The development of Chinese medicine big health industry needs enterprises to strengthen patent portfolio strategy,build patent protection network,actively use litigation strategy,and combine with variety protection system,flexibly use intellectual property strategy to achieve the best protection effect.关键词
