行政权力清单功能的认识误区与归正检视
Misunderstanding and Critical Inspection of Functions of the Administrative Power List
摘要
Abstract
Although the Administrative Power List("List")system has been implemented for many years,the administrative law enforcement and judicial adjudication still have different understanding and constant disagreements of the functional orientation of the List.The List is arbitrarily positioned as"streamlining administration and delegating power","normative documents","administrative self-control"and"legal norms".Under the current judicial review standard of"correct(incorrect)application of laws and regulations",the List shall neither act as basis of judgment nor be regarded as source of laws.On the premises of"legitimacy",the List in the form of normative documents and its supporting documents could be deemed as"basis to affirm the legitimacy of administrative acts".In the practice of administrative system,it is advised to correct such misconception and misconducts as no power beyond the List,performing administrative act purely according to the List and List overwhelms laws and accurately grasp the essential functions of the List,namely information disclosure and power limitation and control.关键词
