The Application Dilemma and Solution for the"Injury While Performing Duties"Clause in Work-related Injury Determination

Abstract
Article 14,Paragraph 3 of Regulations on Work-related Injury Insurance is facing application dilemmas due to the fragmentation of legal interpretation and the ambiguity of the causal relationship standard.Accordingly,it is necessary to clarify the connotation and denotation of the uncertain legal concepts in the"injury while performing duties"clause,and to construct a localized"dynamic hierarchical causal relationship determination model"as the theoretical reference and technical support:the basic layer adopts"direct causal relationship"to ensure the legal stability of traditional workers' work-related injury determination;the correction layer introduces"sufficient causal relationship"to expand the scope of work-related injury protection for new types of workers;the exception layer uses"conditional causal relationship"to assess the responsibility allocation under the influence of intervening factors.关键词
