Theoretical Basis and Promotion Strategy for Confirmation of Rights to National Fitness Data in the Process of Data Assetization
摘要
Abstract
Confirmation of data rights is an important prerequisite for promoting data flow and realizing the value of data.National fitness data is data resourc-es generated in the process of national fitness activities based on various digital fitness equipment,include personal information,personal exercise data,com-petition activity data,physical fitness and health monitoring data,as well as derivative data and data products formed through processing.According to the theory of rights bundles,the dual property rights of data,stipulated by laws and the"input-contribution-benefit"principle of rights and interests distribu-tion,the rights attributes of national fitness data should be clearly defined by classifying and grading the data according to laws and regulations,and identify-ing the value contributions and legitimate rights of each subject in the process of data production,circulation,and use.The rights content of mass fitness data mainly includes the right to hold data resources,the right to process and use data,and the right to operate data products.The scope and responsibilities of each right in different types of data are quite different,define the rights content,scope and responsibilities of personal sports data,enterprise data and public data respectively.At the same time,in order to promote the confirmation of rights to national fitness data,it is necessary to promote it from aspects such as improving the data system,improving the data market,innovating the application of technologies,and strengthening the supervision of rights confirmation.关键词
