巴西油气矿业权管理与改革的经验及其启示
The experience and enlightenment of Brazil's oil and gas mining rights management and reform

Abstract
Since 2000,Brazil's oil and gas industry has achieved rapid development and transformed into an important oil-exporting country,which is attributed to the continuous improvement of the oil and gas management system and the deepening reform of oil and gas mining rights.The main experiences of Brazil's oil and gas mining rights management reform include"legislation first"reform in accordance with the law,establishing a relatively standardized system for the transfer(circulation)of oil and gas mining rights,designating a core or strategic area for national oil and gas resources,as well as perfecting market access conditions and bidding requirements and optimizing the allocation mechanism of mining rights.In response to such main problems in China's oil and gas mining rights reform as neglecting access technical requirements,emphasizing"the highest price wins",and not building a resource strategic area.This paper draws on Brazil's experience,combines with the new"Mineral Resources Law",and puts forward such suggestions as improving and perfecting the legal system to accelerate the legalization process of oil and gas mining rights management reform,improving and perfecting the access system for oil and gas exploration and exploitation to promote high-quality development of the upstream oil and gas industry,establishing and improving the continuation and circulation system of oil and gas mining rights to accelerate the cultivation of the oil and gas mining rights market,and implementing major national strategic deployments and accelerating the construction of oil and gas resource strategic security areas to ensure national energy security.关键词
