全球人工智能立法实践与我国路径研究
Research on Global Artificial Intelligence Legislation Practices and the Path in China
摘要
Abstract
[Research purpose]At present,Al legislation has become a crucial pillar in sustaining international AI competition.Compre-hensively sorting out and analyzing the main types of artificial intelligence legislation worldwide is beneficial for grasping the international trends and impacts of artificial intelligence legislation from a highly reasonable and accurate perspective of global competition.It is of great significance to reasonably grasp the opportunity of AI legislation in China,determine the legislative orientation,select the legislative model and design the legislative system.[Research method]This study adopts literature analysis,comparative research,and type-oriented re-search to systematically sort out global intelligence legislative practice,analyze the possible legislative effects of international legislative practice,and propose suggestions for improving the construction of AI rule of law in China.[Research result/conclusion]There are three main types of artificial intelligence legislation globally:"normative+unified legislation","promoting+decentralized legislation",and"in-termediate path",which have brought different legislative impacts on the competition for international discourse power,development and security of artificial intelligence,and the scientificity and operability of legal systems.Based on the current situation of China's AI legisla-tion and the demand for competition,China should reasonably sublate international legislative experience,adhere to the legislative orienta-tion of"promoting development",accelerate the construction of an AI rule of law system with"AI law"as the core,"domain legislation"as the support,and"unified legislation+domain legislation"as the combination,to further promote China's AI development and seize the voice of international competition.关键词
