Abstract
The Law of the People's Republic of China on Rural Collective Economic Organizations outlines the general and special criteria for determining membership in rural collective economic organizations.Incorporating multiple factors for determining the membership,this law strikes a balance between self-governance and adherence to the rule of law,and provides legal protection for certain groups.The general criteria for determining membership are based on three key elements:household registration,stable rights and obligations,and basic livelihood security.Each of these elements carries varying weights.Household registration is considered the formal criterion for membership,while stable rights and obligations,along with basic livelihood security,are regarded as substantive criteria.Special rules for member identification address two scenarios:new acquisition of member status and partial acquisition of rights by"quasi-members."The two scenarios differ in legal nature and applicable conditions.Exit rules include voluntary withdrawal,statutory loss and statutory retention of membership.In cases of voluntary withdrawal or specific statutory loss,individuals may retain some rights and interests associated with their membership.关键词
