The Rural Collective Economic Organizations in the Management of Contracted Land Fragmentation:Legal Roles and Governance Logic

Abstract
Building China into an agricultural powerhouse is fundamental to achieving a great modern socialist country,and advancing agricultural modernization is essential for high-quality development.Moderate-scale farming is crucial for agricultural modernization,yet fragmentation of contracted land impedes its progress.Challenges arise from the transaction-specific nature of fragmented plots and risks of non-agricultural/non-grain conversion driven by economic incentives during tenure changes.Leveraging the legal persona of rural collective economic organizations as special legal persons,this study demonstrates their normative and functional capacity to serve as central governance hubs for land consolidation in terms of feasibility,obligation,and capability.On this legal basis,an integral framework is proposed to establish internal-external interest coordination mechanisms and full-process supervision systems centered on these organizations,offering a rule-of-law pathway to address contracted land fragmentation.关键词
