农村集体经济组织与村民委员会职能分离的法理阐释与法律实践
Legal Interpretation and Practice of the Functional Separation between Rural Collective Economic Organizations and Villagers'Committees

Abstract
The functional separation between rural collective economic organizations and villagers'committees is a significant issue in China's rural governance.To achieve this goal,it is necessary to clarify the functional boundaries of the two types of organizations within the legal framework.From a historical perspective,the relationship between them has repeatedly evolved and intertwined throughout the reform process,reflecting the evolutionary trajectory from"political and economic integration"to"political and economic separation"and ultimately to"legalized separation".At the normative level,the clarified functions can be categorized into three types:the exclusive functions of villagers'committees,the exclusive functions of rural collective economic organizations,and functions clarified in accordance with the principle that new laws are superior to old laws.The functions that remain unclear at the normative level fall into two types:those with ambiguous responsibility boundaries and those requiring collaborative exercise.For the clarified functions,a specific plan is proposed from a practical perspective,including personnel separation,separate management of assets,separate financial accounting,and independent decision-making.As for the functions that remain unclear,they could be redefined through legal interpretation and normative coordination.关键词
