Law-Policy Coordination in Promoting the Standardized Development of Rural Collective Economic Organizations
摘要
Abstract
The legislative process of The Law of the People's Republic of China on Rural Collective Economic Organizations is characterized by"institutional foundation → property rights reform → organizational standardization → specialized legislation."Our history and current practice show that the sound operation of rural collective organizations and the robust growth of the new collective economy hinge on the coordinated advance of laws and policies.Currently,this coordinated advance is obstructed by divergent statutory definitions of organizational functions across laws,inconsistencies on membership criteria between upper-level and lower-level legislation,and tensions between the long-term imperative of preserving and increasing collective assets and local governments'short-term political incentives.During the process of the legalization of the rural collective economy,some policies will be elevated to laws,while others will persist as policies,alongside the continuous generation of new policies in response to practical needs,which forms a normative framework characterized by the coordinated regulation and dynamic interaction of laws and policies.And this framework constitutes a fundamental institutional feature of China's rural collective economy.关键词
