The New Features,Impact,Future Trends,and Countermeasures Regarding the Security Review of Foreign Investment in Critical Technologies by the United States

Abstract
Critical technologies are the core of a country's industrial development and also the guarantee of national security.By studying the Foreign Investment Security Review Modernization Act of 2018 and related regulations,it can be found that the United States has for the first time extensively mentioned the term,critical technologies,in the factors considered in foreign investment security reviews.It expanded the scope of review for foreign investments involving critical technologies,mandated declarations for such investments,and increased penalties for non-compliance,which have nega-tively effected Chinese investment in the U.S.Not only have more Chinese investments in critical technologies faced scrutiny,but the difficulty and the cost of investing in the U.S.have also risen,leading to a diversion of investment flows.Furthermore,it has intensified Sino-China technological com-petition and undermined the stability of global critical technology supply chains and investment.During the Trump 2.0 era,these trends are likely to intensify.The U.S.treats China differently regarding it as a rival.It is expected to further broaden the jurisdictional scope over critical technologies,further restrict Chinese access to U.S.critical technologies through a'two-way'screening mechanism,and cease the use of mitigation agreements with Chinese investors.This will significantly increase the risks for Chinese investment in the U.S.In response,the Chinese government could adjust the national security exception clauses in international investment treaties to provide legal protection for Chinese investors and utilize various legal tools for countermeasures.Chinese investors should also prudently mitigate risks,pay much attention on pre-investment consultation,and adjust their investment strategies.If subjected to discriminatory treatment,investors should fully utilize available legal remedies within the American system.关键词
