小多边主义视域下南海渔业资源可持续发展的法治模式探索
Exploration of the rule of law model for sustainable development of fishery resources in the South China Sea from the perspective of minilateralism
摘要
Abstract
The geopolitical relations in the South China Sea(SCS)are intricate and the development potential of this open sea is substantial,which lead to the SCS issue becoming one of the most complex maritime disputes globally.Currently,the conservation of fishery resources in the SCS lacks sustainability,raising widespread concerns regarding marine biodiversity in the region.Fisheries cooperation is generally perceived as a less politically charged area.If effective collaboration can be achieved,it may create essential strategic opportunities for cooperation in more politically sensitive domains.This article posits that countries and regions bordering the SCS should adopt a General-Special framework,aiming to ease maritime disputes and resolve fishery conflicts as strategic goals,to achieve marine biodiversity and the sustainable utilization of marine resources as long-term goals,and to ensure marine food security and advancing the marine economy as realistic goals.Paths to make fishery management in the SCS"more environmentally friendly""more soft law"and"depoliticization"include:1)demarcate marine reserves in the SCS and establish regional fishery management organizations,2)leverage the strategic value of the Maritime Silk Road and improve international rule-making level,3)promote consultations regarding the 'SCS Code of Conduct' and pursue multilateral cooperation agreements.Therefore,the economically oriented minilateral consultation model,which highlights common interests,can serve as an effective mechanism for countries surrounding the South China Sea to address the challenges of sustainable development of fishery resources.关键词
