我国涉海水产种质资源保护区特别保护期法律问题研究
Research on legal issues of special protection period in marine aquatic germplasm resources protection areas

Abstract
The delineation of aquatic germplasm resource protection areas is an important policy in China to implement on-site protection of aquatic organisms with high economic and genetic breeding value.The special protection period system for aquatic germplasm resource protection areas is a specific protection system to promote fishery proliferation and conservation within the protected areas.This article takes the special protection period of marine aquatic germplasm resources protection areas as the research object.By dividing the time dimension types of illegal activities within the protection areas of marine aquatic germplasm resources,this paper elucidates the current legal application status in law enforcement in China's marine aquatic germplasm resources protection areas.It is pointed out that in China's aquatic germplasm resource protection areas,there is no clear distinction in administrative legislation penalties between the special protection period and non-special protection periods,and the content of the special protection period in these areas has not been incorporated into the discretionary benchmarks for law enforcement in various regions.In response to the current situation and shortcomings,it is proposed to add provisions in administrative legislation to impose heavier penalties on illegal activities during the special protection period of marine germplasm resources protection areas,and to improve the discretionary standards for law enforcement in various regions,in order to provide theoretical reference for relevant departments' decision-making.关键词
