Judicial Protection of Property Rights and the Cultivation of"Specialized,Refined,Differential and Innovative"Private Small and Medium-Sized Enterprises

Abstract
In recent years,against the backdrop of increasingly stringent international technological blockades,how to create a legal environment that equally protects all types of economic ownership,and better promote the transformation of private small and medium-sized enterprises into"Specialized,Refined,Differential and Innovative"enterprises and the cultivation of new quality productive forces has become a topic of great concern in national governance,academic research and social practice.The clear definition and legal protection of property rights are essential requirements of the socialist market economy,and can provide fundamental incentives for entrepreneurs to innovate and start businesses.However,on the one hand,the cultural customs and traditional norms of various regions in China vary greatly,resulting in significantly different judicial practices involving property rights in different cities under the same legal system.On the other hand,existing research has not deeply considered how to break the realistic shackles of accelerating the formation of new quality productive forces in the private economy from the perspective of judicial protection of property rights. Based on the background of the new era of accelerating the formation of new quality productive forces,this paper manually collects and organizes detailed data such as the registered addresses of"Specialized,Refined,Differential and Innovative"private small and medium-sized enterprises,takes 282 cities at or above the prefecture level as samples,constructs property rights judicial protection indicators at the city level,and researches the impact of property rights judicial protection on the cultivation of"Specialized,Refined,Differential and Innovative"private small and medium-sized enterprises.It finds that property rights judicial protection can not only alleviate the financing constraints faced by private small and medium-sized enterprises,but also suppress the government intervention faced by private small and medium-sized enterprises,and can also strengthen the development confidence of private small and medium-sized enterprises,thereby having a positive impact on the cultivation of local"Specialized,Refined,Differential and Innovative"private small and medium-sized enterprises.Further research finds that the test results using the first batch of typical cases involving judicial protection of private enterprises released by the Supreme People's Procuratorate in January 2019 as an exogenous shock remain unchanged,and the above effect is more obvious in the central and western regions with greater development potential and cities with a better foundation of scientific and technological talents.Finally,the"Specialized,Refined,Differential and Innovative"private small and medium-sized enterprises cultivated with the help of property rights judicial protection will help the local area to better achieve economic growth,innovative development and employment promotion. This paper has the following two theoretical contributions:First,this paper scientifically measures the degree of judicial protection of property rights at the city level,explores its impact on the cultivation of"Specialized,Refined,Differential and Innovative"private small and medium-sized enterprises,and expands the academic literature on the economic consequences of judicial protection of property rights.Second,this paper uses the hand-collected and collated special data such as the registered addresses of"Specialized,Refined,Differential and Innovative"private small and medium-sized enterprises to explore how judicial protection of property rights promotes their cultivation,thereby expanding the academic literature on the motivation for the formation of"Specialized,Refined,Differential and Innovative"private small and medium-sized enterprises. The conclusion shows that all regions need to effectively improve the level of judicial protection of private small and medium-sized enterprises'property rights,thereby promoting the growth of"Specialized,Refined,Differential and Innovative"private small and medium-sized enterprises,and accelerating the formation of new quality productive forces.关键词
