On the obligation of environmental impact assessment for transboundary water resources development

Abstract
The transboundary water resources development may cause significant environmental damage,so it is necessary to introduce transboundary environmental impact assessment systems.In the absence of a universal multilateral treaty on transboundary environmental impact assessment at the global level,as a regional multilateral treaty on transboundary environmental impact assessment,the Espoo Conventionprovidesreferences for environmental impact assessment systems in many countries and influences many normative instruments such as other international agreements related to environmental protection and public participation.The regulatory objects of environmental impact assessment for transboundary water resources development cover global practices,with progressively enriched content and partial remediation ofregulatory deficiencies.The legal connotation of the obligation of environmental impact assessment for transboundary water resources development includes the national obligation to ensure,the duty of care,the procedural obligation,and the continuing obligation.In line with these four obligations,in the planning,review,approval,implementation,and supervision of water resources development projects,capacity building should be strengthened to ensure compliance,behavior orientation should be strengthened to ensure good faith performance,goal orientation should be strengthened to ensure practical performance,and process orientation should be strengthened to ensure consistent performance.China should effectively fulfill its environmental impact assessment obligations in accordance with its national conditions.关键词
