System Configuration for the Valorization of Data Elements from the Perspective of New Quality Productive Forces
摘要
Abstract
This article is based on the era context of digital China strategy and the development of new quality productive forces.It focuses on the deep dilemma of vague ownership definition,conflicting standard systems,obstacles to scene adaptation,and market mechanism failure in the process of data element value transformation,and conducts systematic institutional research.Against the backdrop of digital technology reshaping the paradigm of production factors,the non-competitiveness,strong penetration,and dynamic evolution of data elements have led to the systemic failure of traditional legal regulation and market allocation models.Therefore,this article adopts an interdisciplinary analysis method,integrating legal property rights theory,economic marginal cost principle,and computer science privacy calculation technology,to construct a four-dimensional evolution framework of"legalization standardization scenarization marketization",in order to reveal the unique path of data elements realizing value appreciation through the coupling of liquidity overflow and network externalities. The core innovation of this article lies in three breakthroughs:firstly,establishing a technology empowered governance paradigm,such as proposing a legal code transformation plan,transforming the principle of informed consent into a verifiable privacy computing protocol,constructing a dynamic equity account system through blockchain certification,and solving the problem of virtualization of data ownership definition;Second,it designs a layered scenario adaptation mechanism,such as establishing a dynamic model of data classification and classification based on the domain knowledge map,taking the migration of industrial Internet data to the supply chain financial scenario as an example,to overcome the institutional defects of vertical domain solidification;Thirdly,it reconstructs the foundation of market-oriented institutions,such as advocating the establishment of a special legal entity system for data exchanges to eliminate the paradox of self-regulation,establishing the legal effectiveness of"available but invisible"delivery under federated learning technology,and constructing a dynamic evaluation matrix that integrates quality density and circulation entropy. The conclusion of this article indicates that the key to empowering new productive forces with data elements lies in the collaborative transformation of cultivating workers'data literacy,intelligent contracting of labor data,and virtualization extension of labor objects.The policy implications of this article are mainly reflected in the reform of accounting standards through the hierarchical measurement model of data resource entry into the table,the establishment of a cross regional factor circulation network based on the"East West Calculation"project,and the implementation of tax incentive policies for privacy computing technology enterprises;The academic value lies in bridging the gap between technological governance and legal regulation paradigms.The proposed scenario based grading and classification rules,as well as the mechanism for transforming the legal effectiveness of technical standards,can provide operational solutions for the implementation of The Twenty Data Articles and contribute Chinese wisdom to global data governance to a certain extent.关键词
