Value Realization Mechanism and Regulatory Approach of Carbon Sink Ecological Products

Abstract
In the context of responding to climate change and promoting green and low-carbon development,China regards the realization of the value of carbon sink eco-products as an innovative policy measure to achieve the carbon peak and neutrality targets.The state and governments at all levels have explored a wide variety of carbon sink trading projects through the formulation of laws and policies,but the lack of precise institutional guarantees also makes it difficult to solve major reform problems such as"difficult quantity,difficult to mortgage,difficult to trade,and difficult to realize".In this regard,the existing research mainly uses the methods of economics and management to explore the scarcity and public nature of carbon sink eco-products,and lacks in-depth research on the regulatory system and rights mechanism for the realization of the value of carbon sink eco-products from the perspective of law. Based on the analysis of the institutional basis and practice status of China's current laws and policies,this paper clarifies the legal concepts and basic types of carbon sink eco-products in our country through normative text analysis and typological ideas.At the same time,drawing on Marx's labor value theory,regulation theory and transaction cost theory,the value realization mechanism of"economy-ecology-legal"of carbon sink eco-products is further explained.The study argues that carbon sink eco-products are carbon dioxide absorption mechanisms formed through carbon sequestration measures and derivative rights on the basis of carbon sequestration measures,and China's carbon sink eco-products mainly include carbon sink ecological benefits,tradable carbon sink rights,and green products and services that increase carbon sinks,and realize their value mainly through government paths,"government-market"hybrid paths,and market paths.However,due to the lack of supporting legal system,there are hidden dangers in the practice of realizing the value of carbon sink eco-products,such as insufficient trading power,single compensation means,and unclear nature of rights,which restrict the market transaction and government supervision efficiency of eco-products,so it is necessary to further explore the value realization mechanism of it.From the perspective of economic logic,carbon sink eco-products empower the environmental ecosystem through"environmental production",and the institutional framework of public-private cooperation needs to be adopted.From the perspective of ecological logic,carbon sink eco-products focus on solving the two-way transformation of use value and value and environmental protection problems,and it is more necessary to give full play to the government's regulation to overcome externalities.From the perspective of the logic of the rule of law,the trading of carbon sink eco-products needs to adopt reasonable rights rules and regulatory mechanisms to reduce transaction costs. This paper puts forward the following countermeasures and suggestions:First,the standard system for the realization of the value of carbon sink eco-products should be improved,and the integration of the carbon sink market and the universalization of transactions should be promoted in the market dimension,so as to reduce transaction costs.Second,in the regulatory dimension,a new type of regulatory method of consultation should be adopted to clarify the legal responsibilities of transaction entities and implement effective supervision.Third,in the dimension of rights,based on the property right nature of carbon sink rights,the right basis for the ownership of national atmospheric environmental capacity should be clarified.This paper responds to the questions of"what is a carbon sink eco-product"and"how to realize the value"from the legal level,explains the"economy-ecology-legal"logic of the value realization of carbon sink eco-products,and puts forward the view of the matriarchal basis of national atmospheric environmental capacity ownership.The research in this paper will help to provide a theoretical basis for the research on carbon sink eco-products and the rule of law of"carbon peak and neutrality",and also provide a reference for relevant authorities to formulate regulations and policies.关键词
