迈向赋能型监管:对慈善组织互联网募捐回应性监管的反思
Advancing to Empowering Regulation:Reflections on the Responsive Regulation of Charity Online Fundraising

Abstract
Online fundraising has not only empowered charitable organizations but also increased the difficulty of regulation.Existing research on online fundraising reg-ulation mainly focuses on the government as the regulator,lacking exploration of the responsive interaction between the regulator and the supervisee.Moreover,there is lim-ited reflection on the issues of responsive regulation theory itself based on the current regulatory situation,which hampers the improvement of regulatory effectiveness.This article takes the Chinese Red Cross Society as an example to discuss the regulation of online fundraising undertaken by charitable organizations from the dimensions of respon-siveness,shaping,collaboration,and relationships based on the perspective of Re-sponsive Regulation theory.Drawing on the theory of empowerment,this article pro-poses Empowering Regulation that integrates motivational empowerment,leadership empowerment,and structural empowerment,aiming to proactively prevent regional regulatory feedback lag,inadequate shaping of regulatory awareness and capacity,une-ven distribution of regulatory power and insufficient linkage between the regulator and the supervisee.This research contributes to enrich the theories of charitable organization regulation,foster a regulatory ecosystem with collaborative interaction between the reg-ulator and the supervisee,and to promote the high-quality development of online fundraising.关键词
