数字时代工会维权服务功能的革新
The Innovation of Trade Union's Rights Protection and Service Functions in the Digital Age
摘要
Abstract
The rise of the digital economy has given birth to complex and diverse labor relations.In the digital era,professional workers in new forms of employment face issues such as ambiguous identity positioning and weak bargaining power.When traditional labor relations fail to encompass these new dynamics and existing laws cannot comprehensively protect the rights of workers in new forms of employment,the role of the trade union in safeguarding rights and providing services becomes even more critical.Thus,the digital age has not diminished the importance of the trade union;the key to their continued relevance lies in their legal nature and historical functions.Leveraging institutional advantages and endogenous dynamism,the trade union in the digital era continues to focus on the dual functions of rights protection and service provision,achieving institutional breakthroughs in addressing the challenges faced by workers in new forms of employment.Therefore,the digital era requires the trade union to maintain their institutional strengths while actively developing new models of rights protection and services that align with the characteristics of digital labor.In the future,the trade union must continue to prioritize safeguarding the basic labor rights of workers in new forms of employment,addressing issues such as unfair algorithmic management,the invisibility of work intensity,and new types of occupational hazards.Specifically,efforts should be strengthened in areas such as reasonably determining working hours,ensuring wage payments,and improving occupational safety and health conditions,through enhanced institutional supply and bargaining power,to comprehensively protect the rights of workers in new forms of employment.关键词
