平台用工中算法的法律规制与新就业形态劳动者的权益保障
Legal Regulation of Algorithms in Platform Employment and Protection of Workers'Rights in New Forms of Employment:A Study Based on the Theory of"Incomplete Labor Relations"

Abstract
In platform-based employment,algorithms serve as automated tools for labor management.While platforms rely on algorithms to manage labor,workers'autonomy in determining working hours and workload weakens traditional indicators of subordination,rendering such control difficult to classify as"dominant labor management".As a result,platform work arrangements are rarely recognized as employment relationships under current law,leaving workers in new forms of employment without adequate institutional protections.This underscores the need for a rights protection mechanism tailored to platform work.Based on the characteristics of"incomplete labor relations"outlined in the"Third Batch of Typical Labor and Personnel Dispute Cases",this study develops a theory of rights protection linking"elements of subordination—labor rights and interests".It proposes procedural algorithmic regulation through adapted employers'internal rules and regulations—implemented via the"Forum for Workers in New Forms of Employment"—and substantive regulation through labor baseline standards.The study thereby aims to apply established labor law instruments to"incomplete employment relationships",achieving both effective algorithmic governance and robust labor rights protection.关键词
