Improvement of the Division Rules for Technical Features in Patent Claims
摘要
Abstract
Technical features not only serve as the basic units of patent claims,but also as the core unit for evaluating substantive requirements of patent authorization,such as novelty and inventiveness,and for determining infringement.Nevertheless,our country's current patent legal system lacks a clear conceptual definition for technical features and explicit and uniform rules for their division.This deficiency has led to the definition and division of technical features becoming a focal point of disputes in patent grant and confirmation procedures,as well as in patent infringement litigation.By conducting an in-depth analysis of the meaning of technical features,distinguishing related concepts,and examining the problems in the current judicial practice concerning their division,it is suggested that the definition and division of technical features should be guided by the technical logic and contribution of the invention itself.Based on this premise,it is proposed to optimize the definition of technical features with"function(or effect)+substantial technical contribution"as the core,and to establish systematic division rules and operational steps.关键词
