ChatGPT's Challenges to Jurisprudence of Rights and Their Solutions
摘要
Abstract
ChatGPT is a natural language processing tool driven by artificial intelligence technology,characterized by its generative capabilities,deep synthetic,and open accessibility.As a representative of generative artificial intelligence,it brings unprecedented convenience and efficiency,but also triggers new problems and challenges.Meanwhile,ChatGPT poses new challenges to the modern legal system,which takes rights as its central category,thinking core and value objective.These challenges are mainly reflected in legal principles of rights subjects,the legal principles of rights objects,and the legal principles of rights protection and relief.To prevent and respond to the challenges posed by ChatGPT to the legal system,it is necessary to adhere to the bottom line of humanism,the principle of"maximum non harm"and the principle of reasonable balance of diverse values.In response to the challenges,we can strengthen the legal exploration of ChatGPT,and carry out precise legislation to further clarify the principles and standpoints.Moreover,the pattern of ethics-law-technology collaborative governance,the participation of multiple entities(including government,enterprises,experts,and individuals),as well as typological processing methods can effectively address such challenges.关键词
