The Crisis of Intellectual Property under the Condition of Artificial Intelligence and Its Solutions

Abstract
The development of artificial intelligence has brought a crisis to the field of intellectual property,mainly manifested in the fuzzy boundary between subject and object,the difficulty in defining the ownership of artificial intelligence products,and the paradox of intellectual property system.These crises urgently need a theoretical response as a contemporary problem.However,the traditional intellectual property theory cannot provide evidence for the legitimacy of intellectual property in the era of artificial intelligence.From the perspective of"social man",Marx presents the essence of intellectual property through the lens of historical materialism,providing methodological enlightenment for the plight of intellectual property in the era of artificial intelligence.As an emerging productive force,artificial intelligence is people's production tools or intelligent products;the creative process of artificial intelligence is essentially a process of creative labor with the help of"the extension of the brain";the ownership of artificial intelligence products depends on the production mode involved in artificial intelligence;The paradox of intellectual property system reflects the deep structural contradiction between the commonality of knowledge products and the private ownership of knowledge products.China's intellectual property system should leverage the strengths of socialist production relations,so that artificial intelligence can better play the role of promoting the development of productive forces and make science and technology benefit the people.关键词
