摘要

Abstract

Current practices in Procuratorial Public Interest Litigation(PPIL)encounter three pivotal challenges in judicial reviews concerning"justiciability":ambiguous definitions of public interest,scarcity of judicial resources,and inadequate professional support.To foster the high-quality advancement of PPIL,a dual strategy,integrating jurisprudential logic with procedural safeguards,is indispensable.Theoretically,it necessitates elucidating the evolving notion of"justiciability"within the frameworkhe tension between the logic of the rule of law and practical imperatives.It necessitates adhering strictly to statutory authorization limits while also being responsive to the necessity of safeguarding newly emerging rights.Procedurally,translating"justiciability"into practical efficacy involves establishing a dynamic public interest identification mechanism,enhancing case selection processes and judicial resource distribution and strengthening professional capacity building with inter-departmental collaboration.This systematic framework aims to overcome practical difficulties in the judicial review of"justiciability",enhancing the standardized operation and effectiveness of PPIL in emerging fields and complex cases.
