Legal Regulation of Multiple Risks in Algorithmic Automated Decision—Making Processes
摘要
Abstract
Algorithmic automated decision-making in digital transformation has given rise to systemic risks such as privacy erosion,algorithmic discrimination,and digital power monopolisation.China must establish an integrated governance system grounded in domestic practice.On one hand,it is imperative to resolve the dual dilemma of centralised algorithmic governance authority and accountability failure by re-shaping governance logic around human-centred values.On the other,a multi-stakeholder collaborative governance mechanism must be implemented,clarifying platforms' obligations for algorithmic transparency and establishing third-party technical review standards.This requires synergistic governance across the entire chain through coordinated efforts of government leadership,industry self-regulation,and public o-versight.Regarding redress pathways for algorithmic infringements,the capacity of public interest litiga-tion systems to address systemic risks should be strengthened.A coordinated mechanism for collective liti-gation and technical evidence should be established to overcome individual evidentiary burdens.Concur-rently,the algorithmic liability framework must be refined to achieve a substantive equilibrium between technological controllability and rights protection,thereby providing an institutional model for global algo-rithmic governance.关键词
