The Order of Initiation between Civil and Administrative Public Interest Litigation by Procuratorial Organs

Abstract
When the same act of public interest infringement simultaneously satisfies the filing conditions for both administrative and civil public interest litigation,procuratorial organs may choose to initiate either type of litigation.Whether to give priority to administrative or civil public interest litigation directly affects the effectiveness of procuratorial public interest litigation.Judicial case analyses reveal that,in practice,procuratorial organs adopt varied approaches—some prioritize administrative litigation,others prioritize civil litigation,while some pursue both in parallel.This inconsistency,coupled with ambiguous discretion and arbitrary procedural selection,undermines the standardization and uniformity of judicial practice.To regulate the order of initiating civil and administrative proceedings and to ensure the effectiveness of public interest remedies,the order of initiation should be guided by three core considerations:the protection of public welfare,fairness in litigation,and litigation costs.In principle,administrative public interest litigation should take precedence,with civil public interest litigation as an exception,and concurrent proceedings reserved for special circumstances.Furthermore,clear and specific conditions should be established for initiating each procedure,so as to refine the public interest litigation system and enhance the effectiveness of procuratorial practice.关键词
