安全生产领域应急综合执法的行刑衔接机制研究
On the Coordination between Administrative Penalty and Criminal Punishment in Comprehensive Emergency Law Enforcement in the Workplace Safety Sector

Abstract
The frequent occurrence and significant harm of workplace safety accidents have made enforcement-criminal coor-dination a key issue in comprehensive emergency law enforcement.This coordination achieves accident prevention and accounta-bility by linking administrative penalties with criminal prosecution.However,the current mechanism suffers from inconsistent standards at the regulatory level,poor information and evidence transfer in the procedural stages,and problems in execution such as the substitution of fines for criminal penalties and the failure to transfer existing cases.Legislation should empower emergency management departments with flexibility and the power to handle matters in exceptional circumstances,while standardizing the boundaries of criminalization.Administration should leverage information platforms to promote interdepartmental collaboration,improve resource libraries and a hierarchical talent system,and improve the judicial system to enhance case transfer mechanisms and strengthen assessment,reward,punishment,and supervision systems.Through the coordinated improvement of legislation,administration,and justice,a more solid foundation for workplace safety governance can be provided.关键词
