环境犯罪案件行刑衔接机制的实践困境及其纾解
Practical Dilemmas and Relief Measures of the Coordination between Administrative Penalty and Criminal Punishment in Environmental Crime Cases
摘要
Abstract
Amidst the acceleration of industrialization,the issue of environmental pollution has become increasingly promi-nent,posing more stringent demands on the administrative-criminal integration mechanism for environmental crime cases.Pres-ently,this mechanism is confronted with challenges such as impediments in case transfer,difficulties in evidence conversion,and inadequate supervisory intensity.These issues severely impact law enforcement effectiveness and diminish the deterrent power of the law.In this context,key issues related to the linkage mechanism of environmental crime execution should be explored in depth,and a series of improvement suggestions should be proposed,including clarifying case transfer standards,optimizing evi-dence conversion processes,and strengthening prosecutorial supervision.Making these path choices is to provide theoretical sup-port and practical guidance for solving the above-mentioned problems,thereby enhancing the efficiency and effectiveness of envi-ronmental rule of law.关键词
