论比例原则在生态环境侵权惩罚性赔偿中的适用
On the Application of the Principle of Proportionality in Punitive Compensation for Ecological Environment Infringement
摘要
Abstract
To address the increasingly severe environmental challenges,the Civil Code of the People's Republic of China has instituted a punitive compensation system for ecological and environmental infringement.However,the lack of detailed statutory provisions and objective criteria has led to issues such as inconsistent element identification and substantial variability in determining compensation multipliers.Incorporating the principle of proportionality into the review process of punitive damages system for environmental torts can ensure the system fulfils its due institutional role and offer operational guidelines for judicial discretion.Therefore,a gradient review standard can be developed based on the three sub-principles of necessity,appropriateness and balance within the proportionality frame-work,with quantifiable factors guiding compensation calculations.Ultimately,considering social impacts allows for a comprehensive as-sessment of punitive damages,fostering a balanced integration of punishment,deterrence,and restoration,thereby further enhancing the predictability and credibility of judicial decisions.关键词
