Abstract
In the era of transition from exploration to commercial development in the international seabed ar-ea,international investors have attracted more attention to strengthening their participation in the"Area"activities by investing in developing countries,especially contractors from South Pacific island countries.Foreign investors are primarily from developed countries,and their investment purposes mainly include bet-ter utilizing the favored status of developing countries through"backdoor"means,promoting participation in deep-sea activities of host countries,and exporting technology,equipment,and management services.From a practical perspective,foreign investors in this field mainly face risks or challenges in terms of the sustainability of capital investment,the uncertainty in the timing of the adoption of the draft regulations on exploitation of mineral resources in the Area,the changes in the sponsoring states'regulatory rules,and the unpredictability in resolving related investment disputes.Although the"backdoor"investment has raised questions about regulatory evasion and monopolies,especially the discussion on the interpretation standards of"effective control"of contractors by sponsoring countries,it must also be acknowledged that related in-vestment activities objectively contribute to enhancing the participation of South Pacific island countries in exploration and exploitation activities in the Area.Referring to relevant international practices,China could also consider exploring models,such as establishing wholly-owned subsidiaries or forming joint ventures by domestic enterprises in developing countries including South Pacific island countries,to develop South-South cooperation in the exploration and exploitation of the International Seabed Area.关键词
