生态安全导向下我国生物资源管控立法的难题审视与优化路径
A Review of the Difficulties and Optimisation Paths of China's Biological Resources Control Legislation under the Guidance of Ecological Security

Abstract
Maintaining ecological security is an important mission to promote the construction of an ecological and environmental rule of law system in the new era.In order to integrate biological resources control legislation into the ecological environment legal system,it should take the maintenance of ecological security as the core value orientation,implement the ecological civilisation value of"harmony between human beings and nature",and practice the methodology of holistic management of ecosystems.Currently,the legislation on the control of biological resources is facing the challenges of fragmented legislative structure,unclear legislative logic and insufficient supply of control systems,and is in urgent need of improvement.In this regard,the optimisation path of"structural optimisation‒logical improvement‒institutional improvement"should be followed:in terms of legislative structure,an open architecture should be constructed with the provisions of the Ecological and Environmental Code as the main chapter,supplemented by specialised control legislation,which not only meets the systematic needs of the codification of the Code,but also provides an opportunity for the development of subsequent separate legislation.In terms of legislative structure,an open structure is constructed with the provisions of special chapters of the ecological environment code as the main supplement,which not only responds to the systematic needs of codification,but also reserves space for the development of subsequent legislation.In terms of legislative logic,the Ecological and Environmental Code should take the maintenance of ecological security as its logical guide,and clarifies the definition of"species"with ecological orientation,and then establishes the basic rules for biological resources control,such as the prevention of species risks,the protection of species diversity,and the relief of species damages.In terms of the control system,the legislation should establisn a red line system for biological protection and establish the biological resources inspection system,and endeavour to achieve efficient supervision of control activities.关键词
