Judicial judgments citing judicial policies:Reasons,mechanism and realizing route
摘要
Abstract
In the process of the rule of law in contemporary China,the application of judicial policies in judicial judgments is relatively common.Such policies can bridge the gap between statutory provisions and judicial practice,guide the value orientation of judicial judgments,and provide authoritative support for judicial argumentation.Judicial policies possess distinctive characteristics and intrinsic value functions,and also present unique mechanisms of action in judicial judgments.The application and overall effect of judicial policies in judicial judgments are not ideal,due to insufficient emphasis on the legal methods of invoking judicial policies.In order to fully release the functional value of judicial policies in judicial judgments,there are four specific ways to apply them to judicial judgments,namely,as reasons for judgments to exert the reasoning function,as a basis for interpreting legal concepts and provisions,as an effective way to fill legal loopholes,and as a basis for resolving value conflicts.关键词
