论企业环保信用治理的法治纠偏
On the Legal Rectification of Corporate Environmental Credit Governance

Abstract
Corporate environmental credit governance is an innovative approach to environmental management based on credit systems,comprising two core components:credit evaluation and credit-based rewards and punishments.Functionally,corporate environmental credit governance should focus on restoring the function of environmental reputation mechanisms,reinforcing the function of flexible environmental governance,and optimizing the function of multi-stakeholder collaborative environmental governance.Examining it from the perspectives of stage logic and the rule of law,issues such as reliance on administrative power in credit evaluation,imbalance in the application of credit-based rewards and punishments,and procedural deficiencies in public participation exist within corporate environmental credit governance,which may constrain the full functional realization of this credit governance tool in the corporate environmental management domain.Meta-governance emphasizes collaborative governance by multiple actors under government leadership,making it highly applicable to corporate environmental credit governance.Guided by meta-governance theory,and based on legal improvements,it is necessary to promote market involvement in corporate environmental credit evaluation by introducing third-party assessments and developing industry standards.Furthermore,legal control over corporate environmental credit rewards and punishments should be strengthened through proportional constraints on joint punishments for dishonesty and the institutional balancing of joint rewards for integrity.Finally,procedural rules for public participation should be optimized by safeguarding the public's right to know,ensuring participation channels and opportunities throughout the entire cycle,and guaranteeing the effectiveness of substantive public involvement.关键词
