National Climate Obligations and Foreign Investment Protection Obligations:The Dilemma of Dual Obligations and Its Solution
摘要
Abstract
The national climate obligation system centered on emission reduction has been formed and gradually strengthened,and the low-carbon energy transformation of"defossil energy"is an inevitable trend.However,under the international investment arbitration mechanism of"protecting fossil energy investments",if a country wants to balance international climate obligations with foreign investment protection obligations,it must face potential risks of international investment arbitration.The risk dilemma of state fulfillment of dual obligations is rooted in the underlying logic divergence between international investment law and international climate law.Externalized at the level of rules,this logical divergence is not only reflected in the general lack of systematic consideration of climate issues in IIAs,but also in the difficulty of international climate law to effectively promote the decarbonization of international investment.Accordingly,a deep reform of the regulatory framework of international investment law and international climate law should be carried out,not only to further accelerate the self-transformation of international investment rules towards low carbonization,but also to strengthen the influence of international climate law on the low carbonization of international investment,thus addressing the risk dilemma of dual obligations for nations.关键词
