生态环境修复费用规范的二元构造
The Dual Structure of Ecological and Environmental Restoration Costs Norms

Abstract
Paragraph 2 of Article 1234 and Item 4 of Article 1235 of the Civil Code of the People's Republic of China form a dual regulatory system for ecological and environmental restoration costs.However,there exists confusion regarding the definition of the nature of liability and ambiguity in the legal basis for application.Under the principles of damages law,existing theories generally acknowledge that the nature of ecological and environmental restoration costs is an extension of conduct-based liability,yet a consensus on the nature and relationship of the norms governing these costs has not been reached.Based on the theory of damages law and normative interpretation,ecological and environmental restoration should be subsumed under restitution,and the liability for restoration costs constitutes payment for restitution rather than compensation for loss.Consequently,Item 4 of Article 1235 of the Civil Code of the People's Republic of China constitutes an independent basis for a claim for costs,enabling the rights-holder to directly request payment of restoration costs;Paragraph 2 of Article 1234 serves as a rule for the statutory conversion of liability forms,automatically transforming into cost liability when the tortfeasor fails to perform the conduct-based liability.These two provisions form functionally complementary regulations:the former provides an efficient and direct monetary remedy path,while the latter ensures the ultimate realization of restoration goals through judicial authority.This dual synergistic regulatory structure grants the rights-holder the freedom to choose between electively concurrent claims,thereby maximizing the timeliness and effectiveness of ecological and environmental restoration.关键词
