法典视域下生态环境损害责任教义学展开
The thesis on Doctrinal Development of Ecological Environmental Damage Liability from the Perspective of Ecological Environmental Code in China
摘要
Abstract
Ecological environmental damage liability embodies multiple values such as security,centered on the legal relationship pf ecological environmental damage,it develops through a"dual-tier"structure comprising liability for ecological environmental damage resilience and liability for ecological environmental damage compensation.While the liability has been stipulated in certain ecological environment legislations,it still faces conflicts among norms of equal hierarchy and application deficiencies in specific fields.The judicial decisions concerning demonstrates evolutions and variation in aspects such as subject matter,legal basis,causes and elements.Related articles from Ecological Environmental Code(hereafter referred to as the Draft)contain numerous highlights,yet encounter interpretative and operative challenges.Moving forward,efforts should focus on clarifying the substantial law positioning of ecological environmental damage liability,strengthening the procedural law foundation of'procuratorial power/supervisory power-administrative power-participation right',and adhering to a multi-stakeholder approach involving procuratorial organs,administrative authorities,and non-governmental organization in collaboratively advancing the accountability path for ecological environment damage.This should be achieved by constructing a legal system for ecological environment damage liability,centered on the Draft,specific legislation on ecological environmental damage liability,and legislation concerning public interest litigation by procuratorial organs.关键词
