A review of the legitimacy of public data authorized operation fees
摘要
Abstract
Public data is a strategic resource with dual attributes of governance factors and production factors.The problem of in-come distribution in authorized operation gradually restricts its development and utilization,and the legitimacy of charging is ques-tioned.As a key part of the system design,the public data authorized operation fee originates from the dual authorization of the constitutional spirit and policies and regulations,conforms to the governance logic of public property theory and public-private partnership,and meets the principle of factor allocation efficiency and beneficiary burden.Its existence has the full legitimacy of compensating the operation cost of the system,encouraging the improvement of the relevant system,and ensuring the safety and sustainability of the system.The"public attribute deviation theory""government′s profit-seeking tendency theory"and"open space erosion theory"proposed based on the questioning of purpose justice,procedural justice and result justice,are not compre-hensive enough to form a strong rebuttal to the legitimacy of fees.关键词
