Abstract
How to deal with the expired state-owned non-residential construction land and the construction of management system are important problems that need to be solved urgently.From the methodological perspective,this paper analyzes the internal logic of the system of the expired use right for state-owned non-residential construction land,comments on the existing institutional arrangements,local practice exploration and theoretical research,and proposes that the construction of the management system of the expired use right for state-owned non-residential construction land should firmly adhere to the bottom line of socialist land public ownership,scientifically grasp the appropriate rules of public law control and private law protection,and pay attention to the opposition and unity of justice and efficiency.This paper discusses the construction of management system from two aspects of recovery and renewal after expiration,and puts forward some suggestions on the treatment of original attachments on the spot after recovery,the way of land reuse,as well as the application time,renewal conditions,renewal period and renewal method in the process of renewal.关键词
