职业技能等级认定权社会化转移的现实问题、内在法理与法治路径

Abstract
The socialization delegation of vocational skill level certification authority plays a significant role in strengthening the modern vocational education system.However,the current legal framework governing the exercise of this certification authority remains underdeveloped,leading to practical issues such as the absence of clear and specific laws for its operation,ambiguous legal nature regarding the filing of evaluation institutions,and frequent occurrences of irregularities in vocational skill level certification.In response,the socialization delegation should clarify the internal logic of governance in accordance with the rule of law,define the legal attribute of the status of evaluation institutions,specify the legal nature of both the pre-filing procedures for these institutions and the certification authority itself,and acknowledge the incomplete control that evaluation institutions hold over the certification authority.Building on this foundation,it is necessary to delineate the specific legal responsibilities pertaining to vocational skill level certification authority,construct effective administrative legal regulation mechanisms,and establish a scientific and efficient oversight system for the certification authority in accordance with the law.Taking the development of the legal system as the pathway,we can systematically address the practical problems arising from the socialization delegation of certification authority,thereby providing robust support for the talent evaluation system essential for the high-quality development of vocational education and the construction of a skills-based society in China.关键词
