Abstract
Article 14 of the Regulations on Work-Related Injury Insurance establishes the fundamental rules for determining work-related injuries,with"work-related cause""workplace"and"work hours"serving as the primary evaluative elements.In the context of remote work,blurred boundaries of work hours,ambiguous definitions of the workplace,and overlapping work-related causes have led to significant disputes in practice regarding injury determination.The theory of total quantum,which follows the complementary logic of"elements-total quantum"offers an adaptive approach to resolving these challenges.Under the guidance of this theory,the determination of work-related injuries in remote work scenarios should proceed in two steps:First,analyze the strength of the work-related cause element;if the injury demonstrates a strong correlation with work,it may be directly recognized as work-related.Second,if the work-related cause element exhibits only a weak correlation,further assessment is needed to determine whether the elements of work hours and workplace can supplement the total quantum required for injury determination.关键词
