数字经济模式下新就业形态劳动关系认定标准研究
The Standard for Determining Labor Relationships in New Forms of Employment under the Digital Economy:From the Perspective of Applying the"Dynamic Systematization"Theory to the Protection of Labor Rights and Interests

Abstract
With the in-depth development of the digital economy,new forms of employment exhibit prominent characteristics suc h as flexibility,decentralization,and virtualization.Based on the practical challenges in determining labor relationships in new forms of employment within the digital economy context,this study systematically examines typical issues in platform-based employment,including the use of civil agreements to conceal labor relationships,multi-layered subcontracting to obscure labor relationships,and algorithmic control to solidify labor relationships.It points out that the traditional"tripartite criteria"for determination are inadequate for addressing the characteristics of new employment models,resulting in insufficient protection of workers'rights.To address these issues,the study employs the"dynamic system theory"as an analytical framework.It proposes constructing a"gradient chromatographic"classification system for labor relationships,with"labor subordination"as the core,categorizing employment relationships into three types:labor relationships,incomplete labor relationships,and non-labor relationships.Based on the intensity of subordination,a tiered rights protection mechanism is implemented.The study recommends promoting structural adjustments to the criteria for determining labor relationships from legislative,judicial,and institutional perspectives,strengthening both procedural and substantive regulations for algorithmic management,and establishing tiered protection mechanisms tailored to the characteristics of new forms of employment.This aims to achieve a legal balance between protecting workers'rights and fostering the healthy development of the platform economy.关键词
