宅基地上合作建房协议效力认定的司法实证研究
Judicial Empirical Research on the Validity Determination of Cooperative Housing Construction Agreements on Homesteads

Abstract
Cooperative housing construction by diverse entities on homesteads is crucial for rural revitalization,ensuring farmers'access to housing,and promoting the integrated development of primary,secondary,and tertiary rural industries.It is also a key part of the new round of homestead system reform.Based on an analysis of 77 court judgments concerning the validity determination of cooperative housing construction agreements on homesteads,this study finds that judicial practice suffers from several problems,including an overly broad scope for determining invalidity,insufficient legal basis for such determinations,significant divergence in the handling of invalid agreements,and lack of a legitimate land rights source for non-members of rural collective economic organizations in valid agreements.Therefore,the scope of invalidity determinations should be narrowed by appropriately extending valid judgments;the main types and legal bases for invalidity determinations should be clarified;the handling methods for invalid cooperative housing construction agreements should be optimized,and the proportion of invalidity faults and the scope of losses should be reasonably divided.Besides,it is recommended to legally transform homestead use rights into collective business land use rights to provide a legitimate land rights source for those non-members.These measures aim to enhance the validity determination of cooperative housing construction agreements and promote policies for revitalizing idle homestead land through cooperation.关键词
