"直接产生"标准的教义学重构与AIGC作者身份认定研究
Doctrinal Reconstruction of"Direct Generation"Standard and Identification of AIGC Author
摘要
Abstract
The rapid development of generative artificial intelligence technology challenges the"direct generation"standard of copyright law.Based on the evolution of the standard,it traces back to the"direct generation"jurisprudential changes in the era of technology,photography and algorithm,and points out that the nature of the standard has evolved from"physical control"to"structural dominance"of works.Due to the indirectness of user behavior and the"black box"nature of the algorithm path in AIGC,the existing standards are difficult to effectively identify the creative contributions of human authors.A"direct generation"standard with an expression control path as its core is then proposed,characteristic of continuity of creative intention,causal consistency of expression results and behavior,and substantive control of expression structure.The standard is based on the intellectual property law philosophy of personality theory,labor theory and incentive theory,which shifts the focus of judgment from operational behavior to substantive control in the expression path,and emphasizes the guiding significance of prompt input,feedback intervention,generation and screening in the creation chain.By means of reconstruction of the"direct generation"standard through the doctrinal approach,while ensuring the legitimacy of copyright,it responds to the normative adaptation needs of"human-machine collaboration"creation in the era of artificial intelligence.关键词
