Analysis and Implications of Cross-border Data Flow Violations in Enterprises
摘要
Abstract
[Research purpose]Taking typical cases of cross-border data flow violations as research objects,this paper aims to systematically analyze the compliance challenges and risks faced by enterprises in cross-border data flow in the digital economy era through the conceptualization and generalization of events.Then it provides strategic ideas for enterprises to build a resilient compliance system in the global data governance pattern,offering empirical references and theoretical enlightenment for China to improve the security assessment and regulatory framework of data export.[Research method]Based on the event system theory and the DIKW(Data-Information-Knowledge-Wisdom)theoretical model,this paper uses the exploratory single-case analysis method to conduct analysis of the key event context,regulatory responses and impact consequences of Company A from 2015 to 2021.[Research conclusion]The risk of cross-border flow violations of enterprise data is rooted in three deep contradictions:the contradiction between the increasing value of data elements in multiple scenarios and national strategic security;the contradiction between global data sovereignty game and cross-border operation of enterprises,and the contradiction between conflicting data regulatory rules in various countries and the dilemma of enterprises"two-way compliance".Based on this,this study proposes systematic suggestions in terms of enterprises governance.Enterprises should formulate data value evaluation standards internally,classifying the management of different data,improving the level of technical protection,establishing a sound data security emergency response system,setting up a data sovereignty committee,and paying more attention to the differences of laws in different countries.关键词
