Codification of Norms on Climate Change:A Perspective from the Ecological and Environmental Code(Draft)

Abstract
The codification of norms on climate change needs to balance the dual demands of understanding the intrinsic laws of climate change and adhering to the logic of the rule of law.On one hand,the codification shall show due respect to the interconnection between ecological environmental protection and climate change.On the other hand,it should be based on the commonality between the Ecolog-ical Environmental Code and Climate Change Laws with overall recognition of their potential conflicts and systematic understanding the functional positioning of each sections of the Code in addressing climate changes.In adherence to the"fact-norm"logic of climate change codification,the relevant provisions in the Ecological and Environmental Code(Draft)are yet to be optimized in terms of cli-mate change responses.In the future,the codification should rely on a holistic methodology to expand the indirect carbon-reduction function of the Pollution Prevention and Control Section,enhance the indirect carbon-absorption function of the Ecological Protection Section,and reinforce the direct carbon-sequestion function of the Green Low-carbon Development Section,thereby continuously impro-ving the relevant provisions in the draft.关键词
