Institutional Adaptation and System Construction of the Green Low-carbon Development Section of the Ecological and Environmental Code(Draft)

Abstract
Promoting green low-carbon development has become an inherent requirement for achieving sustainable development in con-frontation with increasingly severe environmental challenges.Incorporating Green Low-carbon Development Section into the Ecological and Environmental Code is not only an inevitable choice for the systematic legislation in the new era,but also aligns with the overall trend of the"Beautiful China"initiative and the concept of sustainable development.However,current theoretical research remains rel-atively insufficient and the normative connotations of green low-carbon development have not been adequately articulated,resulting in challenges of clarifying the internal logic of the provisions within the sections.The Ecological and Environmental Code,which is ente-ring the crucial stage of legislative review,attempts to construct an institutional framework for green low-carbon development centered on the core concept of sustainable development by systematically addressing the theoretical logic and institutional responses regarding its inclusion into the Code in light of the value objectives and institutional functions of the Draft Code.By reviewing and analyzing key sys-tems related to green and low-carbon development,the paper proposes pathways for integrating and optimizing institutional norms in terms of clarifying framework positioning,strengthening regulatory guarantees,refining governance measures,and establishing govern-ance goals.Additionally,it explores the systemic coordination mechanisms between this part and other sections of the Code,with the aim of promoting in-depth integration and systematic innovation of the relevant chapters to lay a solid institutional foundation for the comprehensive green transformation of economic and social development.关键词
