Historical Value and Modern Inspiration of Zhang Shizhi's Judicial Philosophy

Abstract
Zhang Shizhi,the Tingwei(Minister of Justice)of the Western Han Dynasty,embodied the core principles of ancient Chinese legal system through a series of typical cases in judicial practice.Zhang Shizhi's judicial philosophy was formed against the historical background of the early Han Dynasty,characterized by governance based on Huang-Lao thought,economic recovery,and legal system reform.It integrated Confucianism and Legalism,and was supported by Emperor Wen of Han,promoting the governance effect of"400 prison sentences without the need for criminal measures"during the"Wen Jing Zhi Zhi"period.Research indicates that the principles embodied in Zhang Shizhi's judicial practice,such as legal restraint on power,independent exercise of judicial authority,and rationality in punishment,not only laid an important foundation for the formation of the Chinese legal system,but also provided a valuable historical reference for contemporary rule of law construction;Especially in the construction of power balance,the cultivation of judicial credibility,and the transformation of excellent traditional Chinese legal culture,it has sustained enlightening value.关键词
