Study on the International Discourse Function of Foreign-Related Rule of Law and Its Realization Pathways
摘要
Abstract
The dual mission of foreign-related rule of law construction lies in legalizing external engagements and enhancing the influence of international legal discourse.While regulating external interactions and fulfilling international legal obligations,foreign-related rule of law can spearhead the transformation of international legal values and enable active engagement in the formulation,interpretation,and reconfiguration of international rules through the creative adaptation of international law and the global dissemination of domestic legal frameworks.The foundational logic of its international discourse function stems from three dimensions:the structural indeterminacy of international law,the spillover effects of domestic rule of law,and the historical opportunities brought about in the process of China's development.Strengthening the foreign-related legal system serves as the foundation,activating the interpretative and discursive functions of foreign-related judiciary is the key,and reinforcing the rule-practicing projection capacity of foreign-related law enforcement acts as the safeguard.Together,these three elements form a systematic pathway for realizing the international discourse function of foreign-related rule of law.关键词
