新质生产力背景下数据增值利用制度研究
Research on data value-added utilization mechanisms in the context of new quality productive forces
摘要
Abstract
The development of new quality productive forces(NQPFs)has increased demand for data value-added utilization,which supports consumption upgrading through more efficient decision-making.However,inadequate governance rules hinder consumers'access to data at reasonable prices,limiting the participation and constraining NQPF development.Drawing on a comparative legal analysis,this study argues that Chinese legislation should shift from a data protection-centered approach to a utilization-oriented framework.It proposes allocating full data rights to platforms and limited data rights to consumers to facilitate value creation through rights transfer.Platforms should further optimize data pricing and quality to support consumer decision-making.This approach promotes data value-added utilization and fosters NQPF development.关键词
