数字法治转型中NFT数字藏品侵权所得的链上财产处置困境与制度因应
The Dilemma of Disposing On-Chain Assets from NFT Infringement in the Digital Rule of Law Transformation and Institutional Responses

Abstract
Due to their special digital form and circulation model,NFT collectibles make the illegal profits from NFT-related civil infringement cases in the gray area of legal regulation.The disposal of such assets faces both practical and institutional difficulties:the ambiguity of their legal nature,the failure of recovery procedures,and the ineffectiveness of platform liability.In response,it is advisable to clarify the property attributes of NFT digital collectibles,introduce theoretical tools like social interdependence and interest balance,and establish disposal norms that align with the characteristics of digital assets.By designing on-chain enforcement mechanisms,strengthening assistance obligations of the platforms,and improving the supervision path for secondary circulation,it is conductive to the institutional design resonating with the characteristics of digital assets,so as to promote a shift in digital asset regulation from closed infringement remedies to open property governance,and also provide a logical foundation for the future institutional reconstruction of the digital rule of law system.关键词
